That's like saying you can get drunk as long as you don't intend to drive. You can't prove intent like that unless they find you in a room filled with hit lists and blueprints of power stations or response times of cops.

I agree, basically its legal to do in pa so what is the problem?

The meaning of the 2nd was split into two separate subjects by the SCOTUS, when at the time the 2nd was written, the meaning was concerned with a militia, since most were concerned with the formation of a standing army, which seemed unfavorable.
