A little help, for Erie OC rally.
#1
Well, a little information.

There have recently been OC rally's in Erie, the most recent, we even enjoyed a tour through the maritime museum.

One is planned for June 22, this year. But we are running into some issues. A Mr. Karle, the city solicitor. Is intent on enforcing a city ordinance, that violates preemption. What is this ordinance you ask?

Quote:955.06 RECREATIONAL ACTIVITIES
No person shall use, carry or possess firearms of any descriptions, or air-rifles, spring puns, bow and arrows, slings, paint ball weapons or any other forms of weapons potentially inimical to wild life and dangerous to human safety, or any instrument that can be loaded with
and fire blank cartridges, or any kind of trapping device.

Now, that in and of itself, is just bad. But, I did say he was intent on enforcing this? Where is my proof?

That should take you to the news article, with video.

What does this "man" say?

Quote: They can't be armed uh, if one is armed, their subject to a summary offense, the fine is $100-$300, and the uh police are able to enforce the ordinance.

Now, as far as I am concerned, that right there just isn't right. He has been made aware of the law. I can share the letter that was sent to him, by the attorney who we are all working with. But he doesn't seem to care.

Now, you might have noticed, the thread title is asking for help. As many of you have known me from here, and the other board. I don't ask for much. Maybe advice, or a suggestion. But never more than that.

Today, I am asking more. There are several ways you can help.

By sharing this information, and letting it spread, we can help build support. We have people now, who are afraid to attend because of these outright threats, to violate state law.

By attending. The rally is in June, and there is an OC friendly diner across the street from the park. We can meet up before hand, get a late breakfast, and chit chat before the walk.

And the hardest for me to ask. Is if anyone would be able to donate. I know money is tight, but we are putting the attorney on retainer, and trying to

This is from the attorney.

Quote:he potential issue that we face is the fact that the City hasn't enforced the regulation; however, there is the ability to sue in the absence of actual enforcement, if you can show that the entity intends to enforce it.

And for those that understand legal talk.

Quote:we could file an action for a preliminary injunction and declaratory relief, where we would basically be asking the Court to issue a decision enjoining the City from enforcing the statute and finding the statute in violation of Section 6120

I know money is tight. If you could donate even a dollar, it would greatly help.

If anyone can help in any way, it would be greatly appreciated. The link to donate is here.

Honestly, I don't know what his affiliation is.

What I do know, is I am planning to attend. And, I don't care what he plans on doing.

Quote:The Solicitor’s Office, headed by City Solicitor Gregory A. Karle, acts as the attorney for the City of Erie and its officials, by providing legal advise to the Mayor, City Council and various City Departments. It also represents the City in Court actions involving damage claims against the City and in other actions, including the defense allegations of ordinance unconstitutionality; civil rights actions; enforcement of zoning, Building and Traffic code enforcement as well as drafting and approving proposed ordinances, resolutions, deeds, leases, contracts legal pleadings and briefs.

They probably will do what limerick did and refuse to enforce it because, well, they know it is illegal.

That is what happened at the last rally. But this time, they have come out and said they will be enforcing it.

Personally, I think they are just scared that more people will show up if it isn't below freezing.

If we had a legitimate state attorney general, then they could tell Erie that they will sue the city (or whateve Erie is considered) for a lot of money if they violate state law.

The mistake on the lake.

They've been told again & again...but for the most part city council is made up of the agenda minded or the common criminal type, no integrity what so ever. Sound familiar?

On the plus side...the hunting & fishing are great!
