Marie Zienkewicz was accidentally shot and killed by a Warminster police officer as he exchanged gunfire with a man barricaded inside the Jefferson on the Creek apartment complex, the Bucks County district attorney said Thursday.

But the officer did nothing wrong, according to DA David Heckler.

Yet if a citizen accidentally shot an innocent bystander while defending themself, that citizen would be charged. I think police officers should be held to higher standards since they have "so much training and qualifications" to be carrying a firearm.

this is ridiculous, blaming the guy for something he didn't do. he didn't pull the trigger that killed that old lady. Them(township) blaming the guy shifts the blame. as far as the cop is concerned, he does not deserve the position,old saying, can't handle the heat, get out of the kitchen.

A side note:

it all when south when a shyster lawyer sued a bartender for a asshole that drank to much AND WON. From then on it's always been somebody else's fault..

Saw this one coming... Cripes.

"Officers saw Silva in front of doors — one leading to the upper apartment and one to the lower apartment — and then a door being opened, according to court records. Police thought it was the man who had been firing on them, but it was Zienkewicz, the downstairs neighbor, court records show."

Negligent homicide. Plain and simple... prosecute him and release it was an accident but that doesn't give him a no consequences card.

If someone dies during your commission of a violent felony, it's murder. Period. That's the law and has been for a long time. It's a damned good law, because you're responsible for the consequences of your crimes. All of them.

That said, as far as I am concerned, and probably a lot of other folks, the shooting of that old lady was negligent homicide on the part of both the cop who shot her and his commander(s).

This DA and his predecessors have a history of looking the other way at Bucks County police's negligent use of their service weapons. Maybe they think they can't get elected to or function in office without the support of the FOP.

It seems to me it's similar to what just happened in Philly, where the cop who beat the Puerto Rican woman on video was given a free pass by a judge who's married to a cop, in a courtroom packed with supportive cops. Now the FOP is pressing for him to get his job back.

It's pretty clear that nobody wants to take on the Warminster PD's history of shooting people who weren't supposed to have been shot.
