Defending an animal from a person.

This is going to sound like an odd question, but with all the animal cruelty/ torture news stories I've read, I'm wondering if you are legally able to use your firearm to defend an animal in the process of being tortured.

Here's the hypothetical situation.

You're going for a walk around the block. As you turn the corner, you stumble upon an adult burning a cat or dog alive in his back yard. Are we allowed to stop the person with use of deadly force?

I recall several years ago, near me, a person got arrested for hanging up neiborhood cats on his clothline and skinning them alive. This is a disgusting thought, but there are sick people out there.

I'm just wondering if self defense applies to animals as well.

People > animals. I won't shoot a person no matter what they're doing to the animal, but I'll call the cops.

And, I think you'll fry if you do.

What about shooting a dog attacking you or someone else???????

Run of the mill question but opposite of the op's question.

Knowing what people go through in a justified self defense shooting, I'm not shooting anyone over an animal.

After thinking more about it, I've pretty much decided that the shooter would get charged. However, I don't know if I could just stand there and watch either. I think this may be where my pepper spray would make its appearance.

Animals are property. Would you be justified in shooting someone that is smashing out the windows of an unoccupied car? There is your answer. You will go away for a very long time for such an action.

As others have said, observe, record and report.

I love animals and feel they have as much a right to live as any human. Cant say how i would actually react to someone burning a dog alive but im pretty sure he would have a bullet somewhere in his body.

Whose property are you? Humans are animals nothing more nothing less. Just more intelligent than the rest of the kingdom. Not saying i disagree, u WOULD be in a load of trouble for lethally defending a dog.

I just feel i wouldnt be able to watch it happen. As always firing my gun would be a last resort. Violent retaliation of some form would be emminent and deserved for any sicko that would do that to any animal

If that's your attitude, you should not carry a firearm. Anybody not capable of understanding the limits of deadly force has no business being armed. You don't get to shoot people for things that piss you off. You may shoot a person if your life or the life of another HUMAN is in imminent danger of death or serious bodily injury.
