Edward Yealey Arrest 10-8-13 - Legal Update

Yesterday marks a week since I was 'detained' and falsely 'arrested' by the Philadelphia Police Department, without probable cause or a crime even being committed. The Philadelphia Police Department is infamous for being corrupt, inept, and having a general distaste for following the 'Law', in favor of "Making their own rules".

I now find myself in a really screwed up situation... The media company I worked for went belly up, leaving my partner and I broke. We are owed thousands of dollars that we will never see, and are currently looking for a place away from people as well as the corruption of the big cities and other urban areas. So, with that chapter of our lives over, I turned back to my family and friends in Pennsylvania for work to try and re-coup as much of the past three months work as possible.

This brings us to last Tuesday.
I spent the week prior to October 8th as I usually do this time of year, working 13+ hour days putting on concerts and other events. I am an independent sound and lighting tech, and a production manager, something I have done professionally since I was in my teens. Following the latest event, I had to remove drapery and other set pieces the venue provided to the customer. It was something that had taken me all night because I wanted to be on a train fairly early Tuesday to visit my parents in Delaware, where my Pennsylvania LTCF (License To Carry Firearms) is not valid, so I have to 'Open Carry' to abide by the laws. I also prefer to wear a 'Drop Leg' panel for my tools as opposed to a standard tool belt, which many of you have seen me wear in the past. So, after finishing most of my work, I decided to take a nap in the office and finish cutting ropes down and sweeping after I awoke. I woke from my 2 hour nap and decided to get some food at the diner which is owned by the person I was working for and a good friend of mine. (Incidentally, I also helped another good friend install most of the electrical wiring in the diner).
I walked in the diner through the rear entrance as I usually do, and proceeded to serve myself coffee, as I usually do. I then proceeded out the front door to smoke a cigarette, where Sgt. Kevin Bernard of the PPD was already parked (in an illegal spot) in front of the diner, finishing a phone call in his vehicle.
The PPD routinely patronizes the diner on a daily basis, and many of their officers have seen me open carrying without any previous issues.

Sgt. Bernard then exited his vehicle and entered the diner to finish his phone call, pausing along the way to exchange pleasantries with me, exclaiming about how cold and windy it had gotten. Bernard had definitely noticed my openly carried Glock 30 on his way in, but said nothing at first. Later he said he stopped me because he "feared for his life while he ate". I know that if I was concerned, I would have stopped my phone conversation immediately- he did not. Sgt. Bernard entered the diner and stood in front of the dessert display while both finishing his phone call and staring intensely at my sidearm through the window, I had been surfing the internet on my phone as this happened, so my phone was already in my hand. I knew when Bernard exited the diner without making a purchase or even talking to anyone, he was going to ask about my firearm and permit, so I used my 'Quick Camera' button on my phone to start a video recording, which most have seen by this point. Police in Philly are allowed to stop an open carrier and ask them for their LTCF, and also allowed the ridiculous policy of being able to remove a safely holstered weapon from someone for their 'safety'. Knowing this, I expected Sgt. Bernard to ask me for my permit, imagine my surprise when he asked me if I was a security guard, and told me "They told me in there, you are the security guard". Immediately I was on the defensive, knowing he had not spoken a word to anyone inside, I told him no, to which he asked for my ACT 235 card, to which I responded "What does that matter, I'm not a security guard".
I then told Sgt. Bernard I had my PA LTCF, and held up the clear ID carrier i keep my ID and LTCF in, conveniently next to my lawyer's card, in an effort to diffuse the situation being as he had not asked for my LTCF. Instantly, Sgt. Bernard changed his tune and tried to tell me I can't open carry without an 'Act 235' card and that I was suspicious because of the knife I was carrying with my tools, which he referred to as a 'Sword' on my hip.
At this point I realize that Sgt. Bernard is either ignorant of the laws, or has a blatant disregard of them. I am also aware that the PPD has been through training more than once in the past few years, on how to deal with 'Open Carry'. Without going over the entire video step by step, it is obvious that Sgt. Bernard is trying to goad me into admitting that I am "Moonlighting" as a security guard, either because he doesn't like 'Open Carriers' or he needed to come up with something after calling in two other officers for 'backup' for such a dangerous suspect. At one point, while one of the officers and Bernard were inside the Diner trying to figure out what to charge me with, the officer inside noticed I was recording with my phone and ran outside to grab it, this is when the video stops. Sgt. Bernard tells the officer to delete the video, an order I find out later the officer did not follow. The officer pretends to delete the video, shoves the phone back into my pocket, and returns inside to finish debating with Bernard. 30 minutes passes when the two finally emerge from the diner. Sgt. Bernard then informs me, "This is what I'm gonna do... You wanna record this part smart ass?", to which I reply "yes". This infuriates Sgt. Bernard who says "Well now I'm gonna take your gun, take your permit, and issue you a summary offence for having a knife". This is clearly illegal, but Sgt. Bernard was done being told what he can and cannot do by a mere citizen, so I told him he would need to take me to the station if he was going to do something so clearly out of spite, and do it in front of the whole station. The officer that transported me to the station made a point to tell me that he "Didn't want anything to do with this", but was mum during the actual incident.
I arrived at the station, still not having been searched fully, or told that I was being arrested, and waited another 20 minutes for Sgt. Bernard, who had stopped for food. Sgt. Bernard arrived obviously agitated, throwing papers and slamming things on the table, all the while complaining about how "this little shit pushed the issue, making me miss my lunch". Bernard then spent over an hour looking for the city code book, just to be able to find the crime I committed. Once Bernard found the book, he spent the next hour fighting with a computerized system for reports, complaining about the new operating system of his iPhone, taking a 15 minute break to eat, and asking his superiors how to fill out the reports. I assumed this happened because my situation wasn't a normal legal process.
Two hours after my illegal detention, or kidnapping if you will... Sgt. Bernard handed me my paperwork to sign, and told me I could get all my property back, but now I had to deal with the "consequences" because I was a "Prick". He also regaled me with tales of how gun-friendly he was- about how he was a "Lifetime NRA Member" and supports the second amendment, but that "You don't need to be walking around like dirty harry...".

I left the station, and have since been making moves to have my stolen property returned to me.

I guess that brings us to today. I have spoken to my lawyer, who is confident the charges will not stick, and that I will be able to have my property returned in time. This is a time sensitive issue, because my lawyer has informed me that I need to take action within the week to avoid having my firearm melted down. However, he added that there is a chance to have the city pay for my legal fees due to the Uniform Firearms Act of Philadelphia.

All said and done, this incident is going to cost me about $1,800 out of pocket, money that I do not have, and I have limited work to cover these initial expenses. I am an experienced sound engineer and electrician, and am seeking extra work in order to cover these unexpected, unwarranted bills and get my stolen property returned. I am also establishing a legal fund so that those who wish to donate to my cause can assist in seeing justice served in this instance.

This should get you some traction. I'm hoping you put it in pafoa.org as well. I'm not in as strong of a financial position as I normaly was in the past but I should be able to kick in some. Let me see what I can do. Usually what I do here is donation match 1 to 1 for a period of time, usually a day, up to a certain dollar amount. Normally I would set that at $500 right now that would set me back more than normal relative to my salary. However I'm inclinded to find those funds for you. The community here may not be as generous as pafoa or might be more so. Im not sure but I know they were for mark. I'm no longer on pafoa or I would be certain that doing so would raise at least the first $1000. Probably the entire amount in a day or two. Let this video sit for a day here and at pafoa and ill make at least one offer to match donations but that limit might be only for $100. Regardless Im in your corner and will do some promoting of your need in hopes people here will help.

Thank you! I have posted this on pafoa... I found this page through the post there. Someone else started the threads and there was a little interest in donating, so I set some things up and posted an official statement.
There has already been a few donations, and I will post a daily total a little later to make sure everything from today is in one place!

I'm sorry, but I have trouble feeling any sympathy. Must be because Imm a police state worshipping statist.

I'm the administrator of the Facebook group you threw your little tantrum in, by the way. A tantrum you threw for nothing, unless you consider people giving you their honest evaluations "trolling", in which case, welcome to the internet, baby.

Here is my opinion, once again (and this time, you don't get to delete what you don't like reading):

If you're going to poke the bear, you should be loaded for bear. Simple. You knowingly open carried in a hostile environment, carrying a knife, and chose to give the PPD a hard time. When I go to Philly, which is rare, I don't carry a knife, or I conceal, because I know I don't have the finances to wrangle with the PPD in court. I'm also not the type to solicit funds from strangers because I decided to tempt fate.

Go ahead and call me a troll, or a statist, but there it is. You may now resume your crybaby antics.

First of all, I deleted my post because I was INVITED to that group by one of your members. I was promptly verbally assaulted for it.
Second, Your interpretation of the incident is flawed, you should read the other threads.
Third and final, I am not asking for money, People on here and pafoa expressed interest in donating, so I gave them a path.

You seem to have some sort of issue with me, Didn't your mother teach you if you didn't have anything nice to say, keep it to yourself?

Good, since you stated this here, I know I don't have to ever donate to you if you get fucked standing up for the rights I want to enjoy because you have the funds.. I'll help him because he got screwed by someone that thinks making up laws and illegal searches are okay. If only this guy rolls over and conceales and doesn't dear strap on a knife in the future. Maybe he should just let the ppd win this one to cement in their heads that this is acceptable.

I find it is everyone's responsibility, poor or rich, to stand up to unjust prosecution. That might be by giving a buck or at least supportive words. This was and is unjust. I didnt see him being a dick, regardless we all have a right to be dicks anyway. Ill donate just to preserve the right to be a dick without a fucking piece of shit pig making shit up coming over and harassing you...

I guess the poor should and is forced to comply with any ridiculous moron of an officer and illegal law because they don't have cash. I personally wouldn't be affraid to defend myself against an open carry harassment case not the knife part. Regardless, the poor need and should not be silent just because they are poor. Men in good standing are supposed to help those being bullied. Good men stand for justice regardless of their financial possition. That's how I was raised at least.

I hope you succeed and I hope you continue carrying a knife in the future. I carry a knife every time I step onto a public street unless I'm headed to jury duty.

First of all...verbally assaulted? Take your tampon out, junior. Second, I read the thread here thoroughly, and understood it just fine. Third, you did indeed solicit funds on Facebook, in threads which you have since (conveniently) deleted.

People in my group (and other groups) gave you an honest assessment of the situation you voluntarily presented. When your histrionics began, they proceeded to bust your ass. Welcome to the Interwebz, baby. If you recall, I maintained civility, even when you accused me of being a statist. Your continuing drama queen attitude only serves to strengthen my opinion of you, which is: a false activist, simply looking for a handout.

As for my mom, she is a retired schoolteacher, who received degrees in Literature, English, and Secondary Education. My dad received a PhD in History, and minored in Linguistics and some other stuff. They both taught me a great deal, including the lesson you mentioned. They also taught me to see through people's bullshit, to not be a drama queen, to take responsibility for my mistakes, and to not Poke The Fucking Bear.
