Absolutely agree.. IF you read the text on the link I sent you its quite indepth and interesting and the DUI gun thing would be considered negligent the shooting through the floor not.

Okay because my first post in this thread was about how I believe the law should be, not how it actually is. My point is that I think some accidents warrant criminal charges, if you can prove that (wont use the word negligence) carelessness was involved. A freak accident is one thing, but if you are drunk and waving a loaded gun around like an idiot, and accidentally shoot someone in the process, you should be charged with a crime. But if you are holstering and the trigger snags on something and the gun discharges through the floor and hits someone on the floor below you, I don't think any charges are necessary. Somewhere between those two extremes there is a line, and we all might draw it in a different place but I think we can agree that there is a line somewhere.
