Postal worker and police clash in Neffsville; charges lodged

http://lancasteronline.com/article/local...odged.html

Quote:According to a criminal complaint filed before District Judge David Miller, around 2 p.m. July 1 township Detective Brent Shultz was questioning a burglary suspect in the lobby of the post office. Police believed the man might be mailing packages containing stolen materials.

During the questioning, the complaint states, Yoder rushed into the lobby through a door connected to an employee area. He told Shultz to stop what he was doing and leave the building immediately. He also told Shultz to leave the suspect alone, saying the detective had no enforcement power on federal property.

Is property leased by the federal government actually considered federal property? I know the USPS doesn't own the building they're currently using where this happened. Regardless of that, does the employee have the authority to tell the officer to leave?

"Police believed the man might be mailing packages containing stolen materials." Boom! That's postal inspectors' territory. The local PD should have contacted the postal inspectors and investigated the person together. Maybe Yoder can be charged with disorderly conduct, but Yoder should have contacted the postal inspectors unit ASAP and let them know what the local PD were doing.

As for the property. I know Franklin Mills Mall has a post office there. It is leased by the USPS from the company that owns the mall, but they still have signs indicating bringing a firearm into the premises is a federal offense.

Interesting question. I would guess that it would be considered federal property and certainly an employee would have authority to ask someone leave. It seems a little odd having a postal peon flexing his "federal-muscle" on an LEO. I wonder if he knew the suspect. I might even wonder if the postal employee may be assisting in the criminal endeavor.

My experience was always that the feds tended to wait for us to hand them investigations with neat little bows for federal prosecution. Especially something as piddly as using the mail to ship stolen merchandise.

I certainly wouldn't think a postmaster or subordinate would concern himself with jurisdictional issues where matters of law enforcement were concerned.
He was the sort of person who stood on mountaintops during thunderstorms in wet copper armour shouting "All the Gods are bastards."

More information: http://www.wgal.com/news/susquehanna-val...index.html

I wondered if this was connected when I read the original article: http://www.wgal.com/page/search/htv-lan/...index.html

The woman Patrica Burnett was arrested for stealing packages from door steps over a year ago. She's out on bail, since then she's been arrested again for burglary, and again, she's out on bail.

Chop her hands off, problem solved.

Another story about this: http://lancasteronline.com/article/local...-bail.html

Not sure about the court system where someone can so blatantly violate their bail and not have it revoked completely.

I am highly, highly offended by that officer's disregard for the integrity of the mail stream. You do not fuck with the mail stream. There are proper channels for this sort of thing.

Not sure why her bail has just been raised and not completely revoked: http://lancasteronline.com/article/local...arges.html

She committed crimes while out on bail, what the fuck is wrong with the court system?

So, she's made bail. MT residents be aware, the thief is on the streets: http://lancasteronline.com/article/local...-bail.html

Still don't understand why the bail wasn't revoked completely since she violated her bail before.

In Philly, even people with previous records with a history of not showing up to court are sometimes not given bail (depending on the crime) or are given a bail amount but are not required to post it (unsecured bail). These people still continue to not show up for court and are finally given bail or have their bail changed from unsecured to secured or are suppose to forfeit whatever cash their bail was set at. Philly rarely actually gets their bail money in a lot of circumstances. This is why the Philly CJ system is a joke.
