Lancaster store employee pulls own gun.

It could really suck to be you if it turned out he was lying, and that there was no proof whatsoever of what he said.

gascolator QFT. These are fine lines we leave ourselves to determine every time we step out the door. Only you can decide what action to take, when.

I'd imagine a good majority of us would have done the same as the fellow in the article. Me included.

What if you hesitated and didn't and they shot you with the gun hidden in the pocket.....yeah, I realize that if they actually have one they already have the drop on you

Isn't threatening someone that you have a gun grounds for being charged with armed robbery, even if found later that there was none?

Yes it IS armed robbery as per the statute....

§ 3701. Robbery.
(a) Offense defined.--
(1) A person is guilty of robbery if, in the course of committing a theft, he:
(i) inflicts serious bodily injury upon another;
(ii) threatens another with or intentionally puts him in fear of immediate serious bodily injury;

A good question but not the operative one.

Is it grounds for that person to shoot you to death and successfully claim "justifiable homicide?" Particularly if there is no way to independently confirm the assailant's words or actions and there is, in fact, no gun found?
