LTCF questions.
#1
So last year during a he said she said incident that some people here might remember ( I am still prohibited from talking online about it until October) I had a witness, and the other person involved jhad a friend who was a witness for their side.

I was charged with simple assault and reckless engagement.
their other charges they couldn't meet the criteria.

A week later my LTCF was revoked under the "character clause". When I went into return it, they stated "it was because of the charges, if it gets dropped or expunged later, you'll probably get it."

Well due to not having enough money to go to trial, I had to plea it down. Since it was a first time offense, I had to agree to NON-DUI ARD. October 1st 2014 that ends, and I can pay for an expungment. I understand if you apply and get denied, you have to do something in 90 days or your screwed.

I will probably call the sheriff and make an appointment after it gets expunged, talk to him and see what he says. If he says no, then I'll go get an attorney, and then apply.

Has anyone ever dealt with this before? If so, can anyone recommend an attorney in the Lancaster area who is fairly cheap but is good at what they do?

Currently, I am not prohibited for owning any firearm. The more serious charges they could not meet their burden of proof at trail, but I could not afford the $7k (Approx) for the trial. I sold guns and ammo and made $4,000. Which paid for the attorney to help me through the initial part, and now the Non-DUI part.

This whole situation sucks. One thing I learned is I will thoroughly think about helping a friend out again.

Once the expungment goes through I'd like to pick up a glock again. I can do it even before the expungment since none of the charges are prohibitive and I'd like to carry it. I can't open carry since I am on a school zone line.

Sorry I cant help you. I am in middle of the same type of situation right now. It sucks. I am being accused of doing something I honestly did not do but I had to borrow money to get the best attorney in Bucks Co. My trial is set for the end of Feb. I wish you all the best.

Going to trial for your LTCF or for something else? Yeah it fucking sucks.

I didn't qualify for a public defender because I make too much. Just above poverty and I make too much. Who the fuck qualifies for it then?

I had faith in the justice system until last year. If you don't have money to back you up you are honestly fucked. Trials are ridiculously expensive.

Good luck man. Be strong.

Do public defenders even do a good job though? I would be afraid to get one. I have read that you get what you pay for when it comes to lawyers...well, in general, anyway.

I learned the hard way the past two years that lawyers are stinkin' NOT CHEAP. Although it didn't have anything to with criminal stuff...just a business partnership that went bad and other related stuff.

I'll be paying off my loan for my two lawyers for awhile yet. Sigh.

Good luck guys.

In general, no, public defenders suck. Some are there just to get their clients the best plea deals, others act like dicks/bitches because they think their "aggressive" behavior makes them look like a good lawyer, and other public defenders pretend they know what they are doing, when in fact they have no clue. At work, my defendants usually use public defenders 9 out of 10 times. I've also gone up against some of the "best" lawyers in the city. By "best" I mean they try to use every excuse in the world to get the case thrown out or they do whatever it takes to get the trials continued (hoping that eventually the witness/complainant won't show up, resulting in the case getting dropped). I never lost a case....but then again, I come to court with indisputable amounts of evidence, and I know how to professionally testify on the stand. I never hope I have to be seated on the other side of the court room, but if I did, I'd get the best lawyer I could afford.

I know Gunlawer001 from PAFOA has successfully handled expungements in connection with firearm rights. He might be a resource worth looking into.

My idea of the job of Public Defender is that they are there to make sure proper procedure is followed and give the defendant basic advice so as not to do something wrong or that will make the situation worse.
If you want good legal council you have to pay for good legal council.
I've never had to deal with it personally but I've known people who have and from what I've seen and heard from them, that's pretty much the way it goes.
There are three types of people in the world:
Those who make things happen,
Those who watch things happen,
And those who wonder what happened.

Plus, sometimes you need fast legal counsel....if you go the public route, you have to fill out all the paperwork to see if you are eligible, then be connected with the person, and who knows how long you have to wait.

When I needed my second lawyer regarding my ex-business, I was referred to him by my first lawyer. I called him, and told him the situation, and he told me that he needed me in immediately because as it stood, I had such-and-such risk over my head. So he got me in within a week...and with me being prompt with all my paperwork, he was able to open and shut my case in an amazing amount of time. I imagine with public help, they would not have worked so efficiently for me.

I'm happy with my legal help, so I guess I don't mind having to pay for it for the next three years....

Thanks I thought of him but he's a few counties over from me. I'll have to pm him though and see what he thinks.

Maybe by then the state will do away with licenses. Ha!

I had the first attorney who he and I had difference of opinions. I hired one of the attorneys in my county who by reading newspaper had good outcomes for theirs. I had him for the non DUI part. If I had him for the original stuff he thinks it either a would have been tossed or be disorderly conduct at best.

Blah. System is screwed

Lancaster County is within range for him. If I was in your situation, I don't think I'd even consider hiring a different lawyer. I wish you the best of luck.
