Luzerne County sheriff granting machine gun permits

Unlike his predecessor, Luzerne County Sheriff Brian Szumski is approving permits allowing fully automatic machine guns.

Prior Interim Sheriff John Robshaw had refused requests for Class III permits, which also allow weapon silencers and short-barrel shotguns and rifles, because he didn’t believe citizens should possess these items and didn’t want to be held responsible if they were involved in a crime.

The federal form to transfer Class III weapons from dealers to individuals requires the “chief law enforcement officer” in that jurisdiction to certify he or she has no information indicating the applicant will use the transferred item for an illegal purpose.

That's good news, but bad reporting. For one, the Sheriff doesn't "approve" or "grant" anything. They simply certify that they have no knowledge that the person might use the gun in a crime. The ATF is who actually approves the form. Also, it's not a permit. You do not need a permit to own a machine gun. What you need is a $200 tax stamp.

I am going back and forth in the comment section. Apparently he is also chargeing for the back ground check. $5.00.

Not much of an improvement. Off the top of my head it doesn't seem like there is any law stopping him from charging a fee but what do I know.

One thing that has continued to confuse me is why people were not instead going to their local police department for sign off.
The law? The law is a human institution...

Because a lot of local police chiefs will not sign, leaving the sheriff as on of the few remaining options.

Lackawanna County is doing the same thing. When I spoke tothe Lackawann County Sheriff i was told that the county back ground check was to take any liability off of the county.

Personally I have NO issue with the $5.00 its a small price to pay. Better then the Thousands for atrust set up.
