Massachusetts SWAT teams claim they’re private corporations, immune from open records laws

As part of the American Civil Liberties Union’s recent report on police militarization, the Massachusetts chapter of the organization sent open records requests to SWAT teams across that state. It received an interesting response. http://www.washingtonpost.com/news/the-w...ords-laws/

There are deluded and misguided people in the world. The person who came up with that response is one of them. I think he will soon regret taking that tact.
Everytime we look the other way when someone else loses rights we disagree with, we make it easier to lose the rights we support.

That was just about the dumbest response I have ever read. You are to be responsive and responsible to the people you work for....not.. that.

So if a MA SWAT member kicks down your door, yelling "police", do you have the right to shoot first, because after all they really aren't police, but rather hired mercenaries. As my Daddy used to say, "Either you is, or you ain't!"

Legally, it changes nothing. Because, under the pa statute the defense is given to peace officers. So, even if they're working for a private corporation they're still registered as peace officers with the state.

If they work for a private corporation in PA they only have powers "in and upon, and in the immediate and adjacent vicinity of, the property of the corporation."
The Second Amendment does not GIVE us the right. It tells the gov they can not infringe our right.

It doesn't matter where they have powers. The pa statutes don't specify whether or not the actor has powers in their current location. Review the paufa, use of force and stand your ground statutes. A peace officer is a peace officer.

Under the Pa use of force statutes and castle doctrine, as amended by HB 40, it is unlawful to use force to resist an arrest by a peace officer even when knowing the arrest is unlawful.

Thats just not right. A police officer should only be a police officer while on duty. If a cop rents himself out to a corp. or individual said cop should be considered no more special than other person. Dont these statutes make them pretty much untouchable? Doesnt seem right to me.

Have to ask a lawyer on that one. How I read it though, peace officer is a peace officer.
