WASHINGTON -- Two lawmakers from the region introduced bills to strengthen gun laws Tuesday as the national debate on firearms continues to boil.

One measure, by New Jersey Sen. Frank Lautenberg, would ban high-capacity gun magazines, as President Obama has called for. The other, from Congressman Mike Fitzpatrick, a Bucks County Republican, would require states to report people with mental health problems to the FBI's national database for background checks.

Define "mental health problems".....

The scary thing is, checking "Yes I own a gun" on the doctor's questionnaire could be considered a "mental health problem" eventually....

.

According to the article:

Quote:Fitzpatrick, in introducing his plan, cited testimony from gun control advocates who have said that improving background checks could be one of the most effective ways to cut down on gun violence. His plan requires that people involuntarily committed for mental health evaluations -- called 302 commitments -- are reported to the FBI's National Instant Criminal Background Check System.

Considering what it takes to 302 someone, I have no problem with this.

I think you need something more comprehensive. You can be 302'd following one traumatic event. Someone on SSI for mental illness isn't covered under this...yet they are not capable of holding even the most menial of jobs because of their mental health status.

So a neurological disorder that causes issues with things like walking could put someone on SSI. Would that be something that someone would have to worry about if they chose to purchase and own a firearm? It falls under mental health, doesn't it? At the same time, the person is no danger, but can have that used against them.

What's the criteria for reporting? What's the criteria for denying? What recourse does a person have in the event of a denial?

It's a lot more than a simple answer here, especially considering the host of questions that should be asked.

I agree with this. We need to hear specific details on what constitutes a mental heath issue that would warrant denial of ownership. So because I take an SSRI and xanex I have been a "time bomb" the last 25yrs I have had CCP? Who knew? In 25 yrs I have not had to pull my handgun from its holster now all of a sudden Im going to be denied my right to carry. Needless to say I'm not happy with the lack of specifics here.
