New Jersey law requiring 'justifiable need' to carry handgun upheld by federal court

The law is “unsettled” on whether the U.S. Constitution protects the right to bear arms beyond one’s home, the 3rd U.S. Circuit Court panel said.

The New Jersey law requires gun owners to show an urgent need to carry a handgun for self-defense. Both a police official and a judge must approve the permits.

The plaintiffs argued that the decisions could prove arbitrary, but the court disagreed, saying the Handgun Permit Law clearly defines the requirements, along with bans on people with certain criminal histories or mental health issues.

The New Jersey Attorney General’s Office declined to comment on Wednesday’s 2-1 decision.

To me, justifiable need is ridiculous! I mean, by the time you fill out the paperwork, your stalker has probably already found you and gotten rid of you.

It would be interesting to view the records as to what exact "needs" are being given the licenses.

Nobody there is given licenses. It's a decision made by a judge at their discretion and it's a denial 100% of the time. NJ citizens have a much better chance of winning the Mega Millions or Powerball lottery, because their chance of getting a LTCF is 0.

Why shouldn't this go all the way? Gura's set the stage perfectly for this to go all the way. The ruling is actually, oddly enough, what we want if SCOTUS does grab it.

Has everyone here read it yet? It takes time to get through but the majority butchers Heller & McDonald by abusing dicta and trashing what intermediate scrutiny is suppossed to mean. The dissent is beautiful, the stage is set, this is a great case if it goes up the ladder just one more rung.
