New Pa Bill HB1812 - Adds Back In Duty To Retreat
#1
Philly PA democrats at it again, trying to add in all sorts of language to section 505 (Use of Force in Self-Protection) & section 507 (Use of Force for the Protection of Property.) that requires a person to retreat if possible (sound familiar) as well as nonsense about not following someone if a peace officer or dispatcher tells them not to.

So, can the peace officer or dispatcher then be held liable if the suspicious person goes on to rape, rob, kill or otherwise commit criminal acts?

Link to the actual bill: http://www.legis.state.pa.us/cfdocs/legi...12&pn=2604

3(iii) if the actor knows that he can avoid the
4necessity of using such force with complete safety by
5retreating; or
6(iv) if the actor was instructed by a peace officer
7or public safety dispatcher to not pursue another person.

There's your Travon factor They use this same language throughout the proposed bill.

It seems that your legislation is working towards going from stand your ground to a castle doctrine setup.

Since only law abiding citizens obey the laws, any laws that legislate restrictions aid and abet criminals.
Notice the criminals have long records and yet politicians keep attacking the citizen.

And what most people forget is that the dispatcher never told him to stop. he said "we don't need you to do that." That's not an order. No dispatcher will give that kind of order or it's their ass in court being sued.

Either way, another bill that, hopefully, won't see the light of day.
