Kopel: San Diego Sheriff will not seek 9th Circuit en banc in Peruta right to carry case
Late this afternoon, the San Diego County Sheriff's Office issued a press release announcing that it will not seek en banc review of the Peruta decision, which was issued last Friday by a 2-1 panel of the Ninth Circuit. As I detailed in a post last week, Peruta requires that the exercise of the Second Amendment right to carry a licensed firearm for lawful self-defense be considered "good cause" under the California statute providing for the issuance of concealed carry permits.

What's on Second? The Ninth.: Gun rights advance in California
"Everything is spinning out of control," quipped one reader when he sent us this WSJ.com Law Blog headline late last week: "Ninth Circuit Recognizes Right to Bear Arms Outside the Home." That federal court, which has appellate jurisdiction over nine Western and Rocky Mountain states, is famously liberal, so that a ruling favorable to gun rights comes as a surprise. It turns out the 2-1 ruling in Peruta v. San Diego County is true to political type. The judge who wrote it, Diarmuid O'Scannlain, and his concurring colleague, Consuelo Callahan, were appointed by Ronald Reagan and George W. Bush respectively. Dissenter Sidney Thomas was a Clinton appointee.

Doctoring data on kids and guns
The paper (United States Childhood Gun-Violence – Disturbing Trends) took child hospitalization discharge data along with survey responses concerning gun ownership, and applied a weighted analysis to determine that more handguns causes more child deaths and hospitalizations. This came as a surprise to criminologists, and other people with cranial blood supplies, who have watched the number of handguns in circulation rise steadily over the past three decades, while simultaneously watching child firearm deaths decline. Using criminology/epidemiology data gold standards – Center for Disease Control (CDC) mortality databases and Bureau of Alcohol, Tobacco and Firearms Commerce Reports – we can chart these with ease. It shows that while gun availability has risen, fewer kids die.
