Interesting, so they don't charge him with anything but the Philly Knife Ordinance.

I wonder if that is enough for him to get his ltcf revoked?

Ouch for sure! This guy was harassed big time.

So a Swiss Army knife is illegal in public places in Philly, or a pack of razor blades from the hardware store for that matter if I don't happen to be using them at the moment for my profession?

You wouldn't be able to run as many people over with that car if it didn't drive as far. It should only have a 10 gallon fuel tank.

Good thing his LTCF is from Delaware County... it all depends on the severity of the charge...

Translation.... they got him back to the station, someone told them they screwed the pooch and they scrambled for a charge.

Exactly what I was thinking too. I'm sure his attorney will motion to dismiss as the detention itself was illegal.

Here's a rough transcript (unlabeled and unverified) of the first eight minutes or so of the video. I stopped just after he was cuffed.

Quote:What's up bud? You the uh, security guard here?

Nah, I just do some work for Chris.

How's that?

I just do work for Chris.

Security Guard. You have an Act 235 card, right?

Why does it matter?

Yeah, you're walking around with a gun.

Got a permit.

Can I see it?

Why?

Cause you're walking around with a gun.

Yeah but that's not; that's called a Terry Stop.

Listen.

I'm not trying to give you a hard time.

[wind/static]

You're going to give me a, you're going to give me a card or your going to get cuffed, okay, cause you got a gun on you.

It's called a Terry Stop though. You guys should know better.

If you're gonna open your mouth again the next thing I'm gonna do is take the gun off

[radio]

And I'm gonna take the rounds out of it so I know that you have

Until you know I'm clear I got you

I have every right to do that because under the law you need a permit to carry in order to carry. You're open carrying a gun, you had a sword[?} on your, your hip there, whatever you want to call it, you, okay, I got every right to ask you a question. Now it was a, it was a, it was a nice easy conversation until you went to be a dick.

I'm not trying to be a dick.

Well guess what? You are a dick. Okay? Because I was gentleman, and now you pissed me off. Let me see your gun.

[radio]

Sergeant.

I am in charge.

[radio]

You realize I'm on private property, right?

You're outside, sir.

You don't own the property and as far as I know you don't have permission to be there.

Right, I gotchya.

Yeah, you wanna run a male for a permit to carry?

You have to call the 800 number.

[radio]

I'll spell it for you. Yesterday, Eddy, [unclear], Larry, Eddy, Yesterday. First name Edward. Middle name Mark.

800 number, what is that?

Yeah, the 800 number on there is what you're gonna have to do. I've been through this more than a few times. They always call in, and then they say, I don't have it,

No wait, this is Deleware County. You can't have a firearm

Pennsylvania is, Pennsylvania is universal

[radio]

Say again.

Do you have him secured?

Negative … if I need to I can.

[radio]

Yeah this is Delaware County permit to carry right here.

They're universal in PA.

You can't have, you can't live in Pennsylvania, Philadelphia any longer.

You guys have been

I have my update card.

What's that?

I have an update card.

Where's your update card/

Where is it at?

It's in my wallet, ok?

Where's your wallet?

It's in the building.

I was just, you guys just had a call out here yesterday and you cleared me. You guys have been through a bunch of

Check your [?] radio and see if you were here yesterday

You guys have been through a bunch of training courses and stuff.

[radio, phone rings]

I was just sittin' here when you up and ask me for my permit.

[radio]

I know, but you guys should know what you can and can't do.

Dude! Are you gonna tell me what I can and can't do?

When I'm out here and you're outside the building, the law says, the law says, sir, Mr Attorney, okay, you want to be an attorney, I was there talking to you as a gentleman and you wanted to be an ass with me. So now I'm going to explain to you the law. THe law says that every time you're walking down the street, and you have a permit to carry a gun and you want to carry it outside, you need a permit to carry it.

That's located around my neck.

Therefore, I have a right as a law enforcement officer, to make sure that the permit's valid.

Okay.

I have every right to look in your permit, and see. Now, if you're working inside the building you need an Act 235 card.

But I'm not working as a security guard.

Are you working in this building sir?

Not at the moment.

You're not working as a security guard?

I'm a guest in the building. I'm here to eat. Ask every one of them in there they know me. You guys know this is a Terry stop, right?

What's that?

You know this is a Terry stop, right? This is illegal.

I didn't stop you.

Alright.

Just backing up my supervisor.

I understand that. I'm not even giving anybody a hard time about it - he started yelling at me.

Sir do you want to write a report you know where Internal Affairs is?

And I got, I got security cameras and everything right here man it's, I'm not doing anything wrong, I'm sitting here drinking my coffee.

What did I tell yesterday? I said to conceal it better. Obviously you're not concealing it because people keep calling on you.

You gotta know, you gotta know

I was in the restaurant, man.

Yes I open, I told you guys yesterday I normally open carry unless I'm actually working. That's why I carry it around my neck like this, I'm not trying to give you guys a hard time.

What do you do here?

Huh?

What do you do here?

I just do work for Chris.

Do work for Chris? Don't, don't be puttin' a gun on your hip, walkin' around like, like, like you're a cop. You know what I mean? That's what you're doing.

Come on buddy.

[radio]

So what your permit's from Delaware?

No my permit's from Philly, err Pennsylvania. It's uh, it's Delaware County. Pennsylvania though.

Yeah.

Pennsylvania's

You are supposed to conceal it though.

No. Pennsylvania's open carry. If you have a

Philadelphia's not though.

It is if you have a permit.

No, Philadelphia from what they tell us you still gotta conceal it.

You guys just went through a bunch of classes last year, because of Mark Fiorino, I know all about this.

Yeah, it also says you need to conceal in Philadelphia because we're a First Class city.

It's not, it's not concealed across the board.

You got your Act 235 on you?

No.

You don't, you don't have your card on, do you have one?

Do you have an Act 235 card on you?

Are you issued a Act 235?

Why does it matter?

Cause I'm asking you a question!

No sir, I do not.

Your's acting as a security guard and you're not

No I'm not!

licensed to be a security guard.

I am not acting as a security guard.

That's not what your neighborhood, that's what your neighbor

[overlapping voices]

That's what they're telling me inside, that you act like a, that you are a security guard.

No I do not. Who said that?

Doesn't matter who.

Who said that?

It doesn't matter who.

Call Chris right now, call Chris, he's the owner here

I told you yesterday

he's the owner here

[overlap]

What are you arresting me for?

Right now you're being detained. 'Cause as of right now as far as I know you're

For what?

going to be to be locked up.

Because of what?

For not having your Act, because you're a nitwit! Because you could have been a very easy conversation, sir, you took it to this level. So now, you're [?] deal with it.

Thinks he's fucking [inaudible].

Jesus Christ.

Okay, now you can deal with it. All I did was ask you very simple questions, you could of answered 'em and yowled have been on your way. But you wanted to be a jerk and give me a hard time. All I'm trying to do is do my job.

Get up against the wall.

Who do we call from detectives [?]

Just out here looking for my ride to go home man. This is crap.

They verified this yesterday, but there's different rules in the city.
I am not a lawyer.
