How do any of those "cutting weapon" ordinances ever survive any lawsuit? The charge states it is a weapon so it should be covered by Article I sec. 21 as "arms".

From where he was sitting it looked like it belonged to the restaurant (fenced in outdoor dining area). If that's the case, then the knife law wouldn't apply to him. If it did, then the police can lock up every chef who works in restaurants and every person who has a kitchen knife set at their house. Cutting bushes in your backyard with a machete? According to this theory, PPD can lock you up.

The cops put 2300 Gaul because they looked up and saw the crossstreet sign, the address of the video is actually 2424 E York Street. On Google Street View you can't see the diner because it doesn't exist yet. The place just opened this summer.

That's the ADA ramps that was just installed this summer in order for the diner to open.

I can happily inform you guys the OC'er in the OP YouTube video already has obtained excellent legal counsel.

[Edit: And their law office is in the SAME building that Mugshots Diner is located in. Talk about a fkn small world]

So York is considered a highway? Looks more like a decent Fishtown neighborhood to me...

Highway just means street. If a cop hears over their radio "fight on the highway", then that just means people are fighting in the street.

Cutting Weapon. Any knife or other cutting instrument which can be used as a weapon that has a cutting edge similar to that of a knife. No tool or instrument commonly or ordinarily used in a trade, profession or calling shall be considered a cutting weapon while actually being used in the active exercise of that trade, profession or calling.

(2) Prohibited Conduct. No person shall use or possess any cutting weapon upon the public streets or upon any public property at any time.

(3) Penalty. The penalty for violation of this section shall be a fine of not less than three hundred (300) dollars and imprisonment of not less than ninety days.
