PA DOMA Law Banning Gay Marriage Ruled Unconstitutional

Remember we do not have a PA constitutional ban on gay marriage. What we have in our state is a copy of the Federal DOMA law defining what marriage is. The same law the SCOTUS already threw out.

Id imagine by winter of next year gay marriage will be fully legal all over PA. Not one case has yet been won by the NOM people, so... There's that.

It interests me that the government is more worried about social issues than my constitutional right to carry my gun over the NJ border.....

1) The judge issuing this ruling is a Republican.
2) He was appointed by George W. Bush
3) He was endorsed by former senator Rick Santorum

Well, hopefully it goes through.

I got in a debate with some ultra-conservatives last week about gay marriage. By the end of the debate they were stuttering their words and ultimately changed the subject. There's simply no logical argument against it, especially from someone who supposedly supports freedom.

Rugergirl, do I hear someone willing to generate a criminal test case in the Federal courts? (i.e., drive back and forth across the Tacony-Palmyra Bridge until the NJ staties pull you over for speeding, find the gun and your PA LTCF and decide to charge you?)

I can't think of a better way to get that issue heard before the Federal courts.

The only thing that mildly bothers me is how the judge reached the 1983 claims (it starts on Page 14), only because it's an issue in my own Federal lawsuit [I am being sued and some of my other co-defendants are being sued on 1983 grounds]. The judge is very careful though to describe where 1983 kicks in, which is reassuring. Hope SCOTUS fleshes that bit out further.

Lol that would be fun, wouldn't it! Haha. I have kids to raise though....however if I ever get mugged on Jersey side, I'll be sure my hubby sues the state. However I try to avoid crossing the border.....
