David Renner says he is facing a $200 fine for flying a Betsy Ross flag outside his townhouse in Littleton, Colo.

Rules, rules and more rules...unenforceable rules but mostly dumb rules. Dodgy

Gotta love government intrusion into a contract between two parties.


I found that federal law does not trump state law on flying the flag, if such a law exists. So, I searched for Colorado;

"HOAs cannot prohibit the display of the American flag on a unit owner’s property, in a window of the unit, or on a balcony adjoining the unit if the American flag is displayed in a manner consistent with the Federal Flag Code."

Further;

"Community associations are not permitted to ban owners from displaying the American flag on the owner's unit, lot or in any area where the owner has exclusive use or possession. However, the following provisions of the Act do permit community associations to place reasonable regulations on the time, place and manner in which the American flag is displayed."

So it seems that they're allowed to fly them, but the HOA can set rules on how they're flown.

Same, but out west it can be difficult. Unless you wanted to live out in the middle of nowhere around Phoenix, it was all HOA. It was miserable.

The protection for flying the American flag does NOT protect someone flying the Betsy Ross flag. It may have been the American flag at one point, but it is not now.

Much ado about nothing. Read and follow rules or move.
