The Express-Times reports that Alburtis Councilman Kyle A. Bower was arraigned Wednesday on charges stemming from the Oct. 3 incidents and sent to Lehigh County Prison. A judge set Bower’s bail at $5,000, but the teenager won’t be released from custody even if he posts it due to a probation violation.

Bower, a Democrat less than a year into his first borough council term, is on probation after pleading guilty to escape and stalking charges on Jan. 4, the same day he took the oath of office, the newspaper reports.

Bower was sentenced him to two years of probation and 100 hours of community service. Authorities allege the teenage politician’s latest arrest violate conditions of that sentence.

Sadly, the only real way to remove him is at the ballot box. In the old days, his fellow councilmen could remove him. Courts have recently removed that option.

Isn't there still an option that if he is unable to fulfill his duties because he's in jail he could be removed? I don't know, just asking.

He nodded his head as Hammond read the charges against him, answering, "Yes, your honor," when the judge asked whether he understood them and his rights.

Alburtis police say Bower, of the 300 block of Franklin Street, stole campaign signs for Republican candidates Mitt Romney, Charlie Dent and Ryan Mackenzie on Oct. 3 from the front yard of a borough home.

The stolen signs allegedly turned up in the back seat of Bower's car, which Pennsylvania State Police say they found abandoned Oct. 4 on Jaindl Land Co. property in Lower Macungie Township. Also in the car were two bottles of beer, one of them half empty, police said.

Bower drove around in the field, causing nearly $600 damage to an acre and then ditched the car when it became disabled, police said.

He is charged with theft and receiving stolen property in the borough, plus agricultural crop destruction, a second-degree felony, agricultural vandalism, criminal mischief, abandoning a vehicle on public or private property, damage to real property by operation of motor vehicle, travel on cultivated land and restrictions on alcoholic beverages.

His preliminary hearings on both sets of charges are scheduled 2 p.m. Oct. 24.

Lawyer Michael Ira Stump hasn't heard from Bower, who he represented in the earlier cases. Court records indicate the councilman has applied for a public defender.

Stump has said Bower is an alcoholic and in October 2011 entered a treatment program to address his drinking problem. Alcohol, he said, played a role in all the teenager's crimes.

Bower was first arrested in November 2010 in Alburtis. That was followed by a July 2011 arrest in Macungie and an October 2011 arrest in Kutztown, Pa. He's faced charges ranging from escape and resisting arrest to underage drinking and disorderly conduct.
