Phila DA Seth Williams: Mandatory reporting of lost/stolen guns, or jail

Had an exchange on Twitter with DA Seth Williams. His rationale for pushing a Lost/Stolen reporting requirement; which is basically this:

"You are required to report to the police any lost/stolen firearms within a defined period of time after knowing that they are lost or stolen."

Who determines when you "knew"? Why, law enforcement does. And it gets into a battle of semantics on what you knew and when, which will be very costly for anyone at the other end of a prosecution over this type of accusation.

The purpose of the law is meant to go after straw buyers.



I asked Seth: "What stops me from pre-emptively reporting a firearm stolen right after acquiring it?"

He didn't have an answer for that, other than they'll keep an eye out for people who keep picking up new weapons and then immediately report them stolen.

Think it already did, last year. I know city has passed many city ordinances a the past couple years that seem to fall under state preemption, but the PA Supreme Court allowed the lost and stolen.

IIRC, the PASC did not rule on the case, they refused to hear it because the people and the NRA lacked standing because they weren't charged.

Anti groups like CeaseFire touted it as a SC win anyway. In reality L/S is just another in a long list of laws that Philly won't use, while hobbling more law-abiding citizens.

Poor choice of words on my part, allowed, as in they didn't throw it out or over rule it. They did nothing.
