S.C. Supreme Court Abruptly Halts Murder Trial to Hear Arguments on ‘Stand Your Ground’ — After an Armed Intruder Uses It to Justify Killing a Homeowner

http://www.theblaze.com/stories/2013/07/...homeowner/

Quote:Gregg Isaac testified in court this week that he entered the apartment of Antonio Corbitt in 2005 with another man, Tavares World, after World kicked in the door, The State newspaper reported. Isaac testified that as World and Corbitt fought, it looked like Corbitt was going to pull a gun and shoot Isaac, so instead, Isaac shot Corbitt twice. Corbitt stumbled outside and died.

Isaac said he also feared for his life from World, because World had threatened to kill him unless he went along with him.

Isaac’s defense attorney Mark Schnee argued that his client should be granted immunity from prosecution because South Carolina’s 2006 “stand your ground” law allows people to use deadly force if they fear for their lives.

There was talk that criminals were going to try to use the SYG laws to defend their actions. Hopefully this receives the slapping down it deserves.

If the SCSC finds in favor of this cretin I'm pretty sure that the law will be rewritten in a matter of days. Those folks down there just don't hold with criminals getting away with things.

I can't see this being granted, but I could be wrong. He was in the act of committing a crime, admittedly so even. I would think this negates any stand your ground situation since they were the perpetrators. That's logic though, and hopefully this will be used to set a good precedent.

You wouldn't be able to run as many people over with that car if it didn't drive as far. It should only have a 10 gallon fuel tank.

The problem is though you have to take logic out of the equation. Sadly I could see this happening. Don't get me wrong, I hope it does not.
The law? The law is a human institution...

My concern as well. Which way to Vulcan? I don't know how much more I can take!

Yeah by that precedent it wouldn't be hard to get away with murder.

Breaking and entering into your target's house and hoping they threaten to kill you so you can kill them when you are in fear for your life.

That makes zero sense.

It will probably not get the beat down it deserves....

His lawyer should be on trial for coming up with that one. . .
I don't suffer from insanity.
I enjoy every minute of it.
