Senators Agree on New Gun Control Legislation
#1
WASHINGTON — A bipartisan group of senators has reached a deal on legislation that would for the first time create specific federal prohibitions on gun trafficking and the straw purchasing of firearms.

Senate Judiciary Committee Chairman Patrick Leahy says the bill would establish tough penalties for those who buy a firearm or ammunition with the intent of transferring it to someone else. The measure also would make it a crime to smuggle firearms out of the United States.

Quote:SEC. 5. AMENDMENTS TO SECTION 922(d).

Section 922(d) of title 18, United States Code, is amended--

...

(3) by striking the matter following paragraph (9) and inserting the following:
`(10) is prohibited by State or local law from possessing, receiving, selling, shipping, transporting, transferring, or otherwise disposing of the firearm or ammunition;

That means this would be law:

(d) It shall be unlawful for any person to sell or otherwise dispose of any firearm or ammunition to any person knowing or having reasonable cause to believe that such person—

...

`(10) is prohibited by State or local law from possessing, receiving, selling, shipping, transporting, transferring, or otherwise disposing of the firearm or ammunition;

Putting the status of FEDERAL PROHIBITORS more in the hands of local officials (Chicago, Philly, NYC, etc) is a great way to ensure that "equal protection of the law" never occurs.

There is ZERO good cause to codify that text into federal law.

Luckily for him, laws are not retroactive or Eric Holder would be a felon.

Err, no. The police are allowed to break the law while conducting investigations.
