Talked With Scavello About Monroe County Sheriff Requiring Extra Documents

Just got a personal phone call from Mario Scavello (our state rep in Monroe County PA). I missed him at his office on Tuesday at the rally but left a message with his staff about the problems we are having with our local sheriff (Todd Martin) and the extra documentation he requires to get your LTCF. For those that don't know he requires a driver's license AND a copy of your local Berkheimer tax return.

Funny enough his wife had just gotten her license and he knew about the extra paperwork but didn't realize asking for it was against PA law.

He said his next call would be to the sheriff's association and then to the sheriff's office itself.

Nice to see a legislator actually getting involved when a constituent comes to them with a problem.

BTW, I also stopped by and left the same message with representative Peifer - will see if he responds

So any of you here from our area, remember Scavello has always been there for our gun rights and is there when we need him.

He sounded like he would and from seeing him work over the past years I have yet to see him back down or not do what he said he was going to do.

Also hopefully Peifer (who I left a message for and asked Scavello to talk to) will get on board

I dealt with this asshat before. There are a few other illegal things he is doing with the process, and will simply tell you that he can do what he wants because he's the sheriff, even when you show him the statutes in black and white. I have literally stood there and had shouting arguments with this dickhead. I'm thinking of running against him next time around and doing the old 15 minute, in-and-out, no hassle licensing that some sheriffs do. I trust I can count on a vote from everyone here? This douchebag has been oppressing Monroe county residents for too long.

In addition to what you mentioned:

He will not accept an application if your references don't live in Monroe county. This is illegal and needs to be stopped. And I know what you're saying: "But wait! He can't! He has to give you a reason that you app was not approved. Well, pay attention, class: He simply flat-out refuses to even take it. No processing, means no formal denial, means he gets away with official oppression.

He also demands that the app be submitted in person. He explicitly tells you that apps mailed in will not be honored.

I'm pretty sure there's one other thing I'm forgetting, but for now, please mention these to Scavello. Might as well take care of all the issues at once.

Confidential tax documents proving residency in the county? Or was that another county?

How would that go if:

Camera on and visible, walk in with the application. Place it on the counter and state that you are submitting your completed application for your LTCF. Don't pick it back up, or take it back if they try to hand it to you.

If you get the run around with a reply (and I suspect you will), such as 6109 allows for an investigation an C&R garbage, be sure to point out that people new to Monroe, even if already a Pa resident, may have to wait months to get Berkheimer documents, or to find in county references. Which IMO disenfranchises those residents of their 2A rights. Point out that someone moving from another Pa county to Monroe with a valid ltcf which expires shortly after relocating would be left unable to defend themselves because of Martin's illegal requirements.

Well we now have a new problem, our area was just redistricted and Scavello and Pheifer are no longer our reps. Somehow we got bundled in with frigging Luzerne county Angry

Nope this would be the county ... you have to give them a copy of your local tax return (even though it doesn't have to be filled out)

I'd think an easier (and court admissible) way to go would be Certified Mail with return receipt. I believe GunLawyer has mentioned this option. Some courthouses ban recording devices, and AFAIK, they have the authority to do so, so you may be committing a violation yourself when trying to document theirs.

The Sheriff can't simply say "we don't accept via mail", especially when the statute sets the same method as the required notification for denial/revocation.

But he does. A person that lives down the road from me mailed in his app. After hearing nothing for too long, he called and asked about it. They said they didn't have an app under his name. When he told them he mailed it in, they told him that apps MUST be brought to the courthouse in person, and that if he had mailed it in, it had been thrown away upon arrival.
