Today my sheriff threatened to arrest me...(NOT a joke)
#1
Spent over an hour today trying to pick up my new LTCF (already approved). The outing was a huge cluster-fuck with a long list of screw-up by the Franklin county Sheriff's office, including by the Sheriff himself (Dane Anthony).

I do have over an hour of audio, much of it silence while simply waiting for them to figure out the law and decide to not arrest me. I'm still trying to get that converted to .mp3 so I can more easily review and select clips for public posting. Below is a brief synopsis of the 'highlights'.Angry

1. Was discouraged from using lock boxes. Told to put it in car. This was done by "security", not deputies. I declined.

2. Was told to take gun outside and unload it. When I refused, I was told I would not be permitted to enter the courthouse.

3. Was ultimately taken around the back of the courthouse to a sally port, where a deputy took possession of my firearm, and carried it back in to the lockboxes. No idea why this was necessary, as the gun never left the holster, and ultimately was NOT unloaded to be stored.

4. Was asked if I had LTCF. Stated I currently fell under exemption. Deputy was unaware of that exception, told him to look it up in crimes code.

5. After the clerk repeatedly had some kind of technical issue with the system, the sheriff appeared and stated, (NOT an exact quote) "we're probably going to be arresting you for carrying a concealed weapon without a license". Apparently, because of this pending “issue”, they somehow blocked the system from completing the process, which would have sent me on my merry way.

6. Apparently, even after they found the exemption, they still planned to arrest me because the LTCF system showed my LTCF expired in May of 2012, which put me outside of the 6-month window. There was NO RECORD of the LTCF that was (re-)issued after my successful appeal of revocation, which clearly shows an expiration date of February 2013, which DOES put me in the 6-month window.

7. I also informed them that I had a (valid) UT license. I retrieved it from my vehicle, provided it to them, and they verified that it was indeed valid, HOWEVER, they were both unaware that PA had reciprocity with UT, and when they finally figured THAT out, it was their understanding that one must hold a valid PA license in order for the UT license to be valid. The actual facts are that pursuant to changes in UT law, one must now hold a license from their home state to qualify for a new UT license (**If you reside in a state that recognizes the validity of the Utah CFP or has reciprocity with Utah**), that change has NO effect on the validity of currently held UT non-resident licenses.

Just out of curiosity... What is your exemption? If you don't mind me asking?

Quote:(12) A person who has a lawfully issued license to carry a firearm pursuant to section 6109 (relating to licenses) and that said license expired within six months prior to the date of arrest and that the individual is otherwise eligible for renewal of the license.

My old license expired mid-February of this year (within the 6-month window). I am (provably) eligible for renewal, because I had already received a post card stating that I had passed the PICS check, and should come pick up the new license.

Do you really think they planned to arrest you, or were they just talking smack to intimidate you?

I believe it was a legitimate threat, based on their lack of understanding of the law. The sheriff absolutely believed I was not in compliance with the law, and as such, it was his job to arrest me. I've had contact with him off and on over the last 6 years and I feel I know enough about his demeanor to make this call. I was not surprised to learn he would arrest me if I were not in compliance with the law, but I was stupified that they were so clueless on what the law actually was - on several different fronts.

Yup! I am carrying under that exemption right now (and with a Utah) until I decide what to do about this asshat we have for a sheriff.

You know my thoughts on it.

Just crazy that these people who are there to enforce the law, don't know the law.
This will be the best security for maintaining our liberties. A nation of well-informed men who have been taught to know and prize the rights which God has given them cannot be enslaved. It is in the religion of ignorance that tyranny begins. -Ben Franklin
