Utah Gay Marriage Ban Struck Down As Unconstitutional

"SALT LAKE CITY (AP) — A federal judge has struck down Utah's same-sex marriage ban, saying it is unconstitutional.

U.S. District Judge Robert J. Shelby issued a 53-page ruling Friday saying Utah's law passed by voters in 2004 violates gay and lesbian couples' rights to due process and equal protection under the 14th Amendment.

Shelby says the state failed to show that allowing same-sex marriages would affect opposite-sex marriages in any way, and the state's unsupported fears and speculations are insufficient to justify deny allowing same-sex marriages."

I'd like to note, that I've predicted several times, that gay marriage bans would fall to the 14th Amendment, just like interracial marriage bans fell.

It is unconstitutional. Furthermore the government shouldn't even be in the marriage business. Certainly not the feds. If we were smart we'd dump marriage as a government recognized anything.. its simply a ceremony that is as sacred or worthless as those that participate in it. There should be no benefit nor liability based on it. Furthermore if a state says you have the right to carry than you should have that same right in another. The constitution says as much. I'd love it if we didn't honor drivers licenses from the same states that don't allow our ltcfs. Watch how quickly some judge says that it illegal.. arizona and new Hampshire should make every drivers license and id into a pistol permit so long as the person isnt prohibited. That would be fun for everyone...

Just as a single drip can wear away rock, so can a minority, if consistently persistent, make an impact and change the laws.

The government being able to have any say with regards to who can marry who, not just gays, is what ought to be struck down. Marriage is an agreement between me, my significant other, and in some cases, but not all, a religious institution or other 3rd party. The state should have no say at all one way or the other, it's none of the state's business.

Yes yes we all agree the government shouldn't be involved. We say it every time gay marriage comes up. The fact of the matter is that it is involved, and this judge made the correct decision based on that fact.
