Veterans Are Receiving Letters From VA Prohibiting Ownership Of Firearms

Yet, as I write this I have a copy of such a letter right in front of me. It is being sent by the U.S. Department of Veterans Affairs to hundreds, perhaps thousands, of America’s heroes. In my capacity as Executive Director of the United States Justice Foundation (USJF) I have been contacted by some of these veterans and the stories I am getting are appalling.

The letter provides no specifics on the reasons for the proposed finding of incompetency; just that is based on a determination by someone in the VA. In every state in the United States no one can be declared incompetent to administer their own affairs without due process of law and that usually requires a judicial hearing with evidence being offered to prove to a judge that the person is indeed incompetent. This is a requirement of the Fifth Amendment to the U.S. Constitution that states that no person shall “… be deprived of life, liberty, or property without due process of law…”.

That letter says that you have been found to not be mentally or physically able to handle your VA payment benefits. This is probably because the guy is looking to have someone else handle it or is literally unable to do so. If he is unable to mentally handle a va payment then that's a flag that they are loony tunes. I'm lost as to why this is a problem. I'm sure the VA will conduct a adjudication of incompetency and you have the instructions on this paper on how to fight it. You can't declare yourself unable to work or handle benefits because your nuts and not be adjudicated nuts.

AND they are looking into the criteria used WHICH were not disclosed.

I DON'T BUY ANY OF THAT UNLESS A CLERICAL MISTAKE HAPPENED. The VA isn't going to transfer custody of benefits to a third party for no reason. Come on.

Obviously, the Department of Veterans Affairs can’t be bothered by such impediments as the Constitution, particularly since they are clearly pushing to fulfill one of Obama’s main goals, the disarming of the American people. Janet Napolitano has already warned law enforcement that some of the most dangerous among us are America’s heroes, our veterans, and now according to this letter from the VA they can be prohibited from buying or even possessing a firearm because of a physical or mental disability.

Paranoia doesn't suit us well. The VA isn't arbitrarily going to allow a third party to control anyone's benefits.

not having reliable transportation to the bank and grocery store is no reason to disarm a veteran. i'm okay with senior citizens letting their young ones do the running around. it keeps me from being stuck behind someone going 20 under the speed limit with his blinker on constantly.

There only talking about mental incapacity and still they aren't going to label you incapacitated just because you want to allow jr. to cash a check..

Interview questions about depression and how safe you feel in your own home are standard for every medical visit to the VA clinic. They ask me those questions at every appointment now.

Of course, life is always rainbows and unicorns for me . . . anybody with their wits about them will be careful how they answer those questions. Anybody without their wits about them probably shouldn't have a firearm.

Isn't that the mental health discussion we've been having since Sandy Hook?
